Law Practice

Kim's practice emphasizes a wide range of litigation matters, including commercial litigation, commercial collections, personal injury defense, real estate litigation, and employment law. She is an advocate for her clients and provides them with practical advice and strong representation to protect their interests and help them achieve their objectives as efficiently as possible.

Over the past fourteen years she has successfully arbitrated and tried cases for businesses and financial institutions as well as assisted numerous clients in negotiating favorable ends to their litigation disputes in all facets of business. Kim has handled cases involving complex trade secret protection litigation, personal injury defense, employment law, securities violations, real estate and boundary disputes, homeowners association disputes, defense of consumer law claims and complex commercial litigation.

Kim has been selected by peers to the Oregon Rising Stars list in 2009, 2010, 2011 and 2012 an honor bestowed on only 2.5% of Oregon Lawyers under the age of 40 or in practice for less than ten years.

Representative Matters

Commercial Litigation:

  • Lacamas Community Credit Union v. Hannah Motors - Represented Credit Union in fraud and breach of contract actions; assisted in prosecution of successful summary judgment and favorable settlement.
  • Bouwman v. Accredited Home Lenders - Successfully defended mortgage lender on TILA claim and enforced mediated settlement agreement.

Real Estate Litigation:

  • Albertine v. Hummel - Successfully prosecuted adverse possession and trespass claims through trial.
  • PacifiCorp v. Motes - Successfully prosecuted prescriptive easement claims and obtained favorable appellate ruling on issue of first impression.
  • Olyaee v. Charter Communications - Successfully defended adverse possession claim, prevailing on motion for summary judgment, and defended judgment on appeal. 

 

Creditors' Rights Litigation:

  • Represented financial institution in receivership and foreclosure of commercial building in Lake Oswego, Oregon.
  • Represented financial institution in receivership and foreclosure of 14 condominium units in Beaverton, Oregon.

 

Personal Injury/Products Liability Litigation:

  • Regas v. Sico - Successful settlement of a case involving an alleged defective portable bed.
  • Svitek v. Nidecker - Successfully defended a snowboard manufacturer in a $16 million products liability case.

 

Employment Litigation:

  • Defended wage and hour class action involving donning and doffing claims.
  • Defended workers compensation retaliation claims to a favorable settlement.

Community Involvement

Kim volunteers her time to the Oregon State Bar and Oregon Law Center, providing pro bono legal services to each. She is also actively involved in her local PTA and other education-based organizations, and is a member of the Board of Directors for the Classroom Law Project.

Personal

Kim enjoys reading, gardening, and traveling. Kim is married to an attorney whose practice emphasizes employee benefits and they have two young daughters.
